A Landmark Victory in the Seventh Circuit
McCrummen client wins a second chance to have his case heard by the Board of Immigration Appeals. On July 14, the Seventh Circuit issued a precedential decision rejecting the Department of Justice's position that if an immigrant is deported while his case is still pending before the Department, it is no longer bound to make a decision on his case. The Seventh Circuit decided that the Department had overstepped the power Congress had granted it and remanded the case for a new decision.
