Adjustment of Status verses Consular Processing
Two questions often arise after an employment based application to adjust status has been filed: “At what point am I free to leave my current employer without disrupting my application to adjust status?” or “What if I am laid off? Will my adjustment of status application be denied?”
Additional Questions:
What if I am laid off after my adjustment has been pending for 180 days? How much time do I have to find a new position?
What kind of proof will I need to submit to show eligibility for portability?
If I change employers should I notify the CIS at that time?
Does my new job have to be in the same geographical location?
Can I leave my present employer if my adjustment has been pending for more than 180 days, but my I-140 is not yet approved?
What if my I-140 has been approved and the employer decides to withdraw it?
If my new job is in a different geographical location, will that delay my case? Will my file have to be transferred to a new Service Center?
